A NSW engineer is being investigated over apartment “structural issues” in a first for the state.

Industry body Engineers Australia is investigating complaints against engineer Anthony Hasham after being notified by NSW building commissioner David Chandler.

It marks the first time that NSW's construction watchdog has referred an engineer to the organisation.

Mr Hasham's company, Australian Consulting Engineers (ACE), oversaw the construction of the Skyview apartment complex in Castle Hill in Sydney's north-west.

Inspectors from NSW Fair Trading found “structural issues that would require specialist engineering advice” in the basement of two towers.

The Skyview complex plans involve the construction of five towers, two of which are now complete. Residents were held back from moving into the two completed towers because of the structural issues. 

Developer Toplace has agreed to be liable for any potential future “defects” for 20 years, but the focus is now on Mr Hasham, who denies any wrongdoing. 

Engineers Australia says he could be stripped of his accreditation and possibly registration on the National Engineers Register (NER).

“Sanctions could include a written warning or reprimand, suspension or cancellation of their membership, or removal of the member's title,” a spokesperson said.

The NSW Building Commissioner has called on Engineers Australia to act.

“It is important that industry associations also hold their members to account and consider potential breaches of their Code of Conduct,” he said.

If the accreditation is removed, it would not stop Mr Hasham practicing, but may impact his ability to attract future clients.

“I wish to note that an investigation or an allegation made does not in itself result or equate to negligence or guilt,” Mr Hasham said in a statement.

“I deny any wrongdoing.

“I will be providing full cooperation to the investigation as and when I am called upon.”

Mr Hasham was granted a medal of the order of Australia (OAM) earlier this year for his service to business and Australia's Lebanese community.

He is the engineer behind the Box Hill City Centre - the centrepiece of a major transformation in Sydney's Hills District. The Hills Shire Council says it does not have to send extra inspectors to review the project, as developer Toplace has its own private certifier.
